From 1 August 2025, all sellers of commercial property in Queensland must provide buyers with a legally compliant Seller Disclosure Statement before signing a contract under the new Property Law Act 2023.

Should I Get a Lawyer or a Conveyancer to Review the Draft Contract Before Signing?It?
We highly recommend seeking our advice prior to signing the contract. This ensures that all relevant details are correct and all conditions are drafted to ensure your interests are adequately protected. What Are ‘Essential Searches’ and Why Do They Need to Be Completed?
It’s important we carry out certain searches to check that the seller has met their disclosure obligations, that warranties in the contract are correct, and to obtain information required to assist in your conveyance. Some search results may reveal rights to terminate the contract or claim compensation from the seller. Other searches might show potential adverse issues or restrictions affecting your use of the property.
How Much Transfer Duty (‘Stamp Duty’) Will I Have to Pay?
Transfer duty, also known as stamp duty, is a tax owed to the Queensland Government when purchasing property. It’s paid by the buyer, not the seller. The amount depends on the purchase price and any concessions or exemptions you may be eligible for. Our conveyancing team will discuss stamp duty early on so you can factor it into your budget.
What Should I Look for at My Pre-Settlement Inspection?
For buyers, the pre-settlement inspection is your chance to ensure the property is in the same (or better) condition than when you signed the contract. Check that included appliances and chattels are still present, working, and undamaged. Also confirm that any repairs required by the seller have been completed.
As a Seller, Do I Still Pay My Rates After the Contract Has Been Signed?
Before settlement, rates searches determine what you’ve already paid. If you’ve paid rates in advance, an adjustment will be made in your favour at settlement so you’re reimbursed for the period after settlement. To simplify these adjustments, we recommend sellers stop making payments at least two weeks prior to settlement.
Does My Conveyancer Have to Be in the Same Location as the Property?
Not at all. At Enterprise Legal, we pride ourselves on being a paperless firm wherever possible. Most communication happens over the phone, by text, or via email. Any original documents that need signing can be express posted to you for completion in your location.
