What’s the Difference Between Wills & Estates and Succession Planning?

While they’re closely related, estate planning and succession planning serve different purposes:

  • Wills & Estates focuses on your personal affairs. It ensures your assets are distributed in accordance with your wishes, and that the right people are appointed to manage your estate and healthcare if something happens to you.
  • Succession Planning focuses on business and property transitions, including how shares, trusts or family businesses are passed on. It often involves planning for events that occur during your lifetime, not just after death.

If you own business or investment assets, your Will and your succession plan must be properly aligned. Learn more on our Succession Planning page.

What’s Included in an Enterprise Legal Estate Plan?

Every Estate Plan prepared by Enterprise Legal includes:

  • Either a Simple Will or a Testamentary Trust Will, tailored to your circumstances
  • An Enduring Power of Attorney, appointing someone to act for you in financial or personal matters if you lose capacity
  • An Advance Health Directive, setting out your healthcare wishes in the event you can’t speak for yourself
  • A Letter of Wishes, providing non-binding but helpful guidance to your executor and loved ones
  • Professional advice and review of superannuation and insurance nominations, where relevant

All documents are compliant with Queensland law and prepared with clarity, sensitivity and precision.

Simple Will vs Testamentary Trust Will…
What’s the Difference?

A Simple Will sets out your basic wishes; who should receive your assets and who should be in charge of your estate. It suits many people with uncomplicated family or financial situations.

A Testamentary Trust Will includes one or more trusts that are created upon your death, offering enhanced protection and flexibility. These are ideal if you want to:

  • Protect assets from bankruptcy, divorce or legal claims
  • Provide long-term support for minors or vulnerable beneficiaries
  • Minimise tax through income splitting
  • Control how and when assets are distributed

We’ll help you decide which structure best suits your goals.

Do I need a Will even if I don’t own much?
Yes. A Will ensures your wishes are respected, and it makes things easier for your loved ones. It also appoints an executor and provides certainty around even modest assets.
Can I use a DIY Will kit instead?
DIY kits often create invalid, incomplete or legally unclear documents. Our professionally prepared Wills are properly witnessed and tailored to your circumstances, reducing the risk of costly disputes.
What if I have a blended family or complex estate?
We frequently assist clients with blended families, trusts, family farms or business assets. We’ll help you structure your Will and Power of Attorney documents accordingly.
Can you work with my accountant or adviser?
Absolutely. We often coordinate with clients’ accountants and financial planners to ensure the estate plan fits into their broader succession and tax planning strategy.
